Terms
The terms that apply when you order a guide.
These terms govern your use of Northcliff Journeys, a business line of Northcliff AI, a registered trading name of Spark GTM Consulting (KvK 90876385), Amsterdam, the Netherlands. By ordering a guide you accept them in full.
Definitions
Unless it says otherwise, these words mean the following.
- Northcliff Journeys, we, us, our. Northcliff Journeys, a business line of Northcliff AI, a registered trading name of Spark GTM Consulting (KvK 90876385), the business that provides the service.
- You, your. The person or company that orders a guide.
- Consumer. Someone ordering outside any trade, business or profession. Where Dutch or EU consumer law gives consumers more protection than these terms do, that law wins.
- Service. Everything we do to research, build and deliver your guide, including the preview, the delivered guide and the pre-trip refresh.
- Questionnaire. The form you fill in after paying, which tells us who is coming, where you are staying and how your days run.
- Guide. The finished interactive web guide built for your trip, hosted at a private address.
- Preview. The early version of your guide, live within minutes of your questionnaire reaching us.
- Pre-trip refresh. The re-check of time-sensitive places three days before you travel, and the update to your guide that follows it.
- Agreement. The contract between you and us, formed when you pay.
- CC. The Dutch Civil Code, the Burgerlijk Wetboek.
1. Applicability
- These terms apply to every offer we make and every guide we build.
- Ordering a guide means accepting them in full.
- Your own general terms and conditions, if you have any, do not apply.
- Anything that differs from these terms is only binding if we agree to it in writing. Nothing said on a call changes them by itself.
- We may use other companies to help deliver the service. These terms cover that.
- Where a specific written agreement between us conflicts with these terms, the specific agreement wins for that piece of work.
2. How the agreement is made
- The agreement is made when your payment succeeds. That is the moment you accept these terms, and their effective date is 9 August 2026.
- We may decline an order without giving a reason, in which case we refund you in full.
- These terms replace anything said or written before them about the same order.
3. What we provide
- We research and build a private interactive travel guide for one family and one trip, based on the answers you give us in the questionnaire.
- Every guide includes: day plans built around your children's ages and pace, the sources we checked each place against, a live preview then one delivery date, a guide that works on your phone without signal, and the pre-trip refresh three days before you fly. A fifteen minute call before we start is available if you want one.
- The service is a one-off piece of work, not a subscription. There is no account, no login and nothing recurring to cancel.
- Beyond the specific promises in these terms and in the refund policy, the service is provided as it is. We do not warrant that it will be uninterrupted or free of errors.
- We do not promise that your trip will go well, or that any guide can make it. What we promise is the work described in section 11.
4. Ordering, and the questionnaire
- You order by paying for one of the three tiers. There is nothing to sign up for.
- You must be at least 18.
- Nothing starts until your questionnaire reaches us. It takes about five minutes and it asks about everyone travelling.
- You are responsible for the answers being accurate. A guide built on the wrong dates, the wrong town or the wrong accommodation is wrong through no fault of ours, and section 17 applies to what follows from that.
- If your answers leave something genuinely unclear, we will ask rather than guess.
- If you never send the questionnaire, we cannot build anything. The refund policy covers what happens then.
5. The three tiers, and what each covers
- Price follows the number of places you sleep, because that is what the research volume follows. The three tiers are:
| Tier | Price | Scope |
|---|---|---|
| One place to stay | $99 | One base, up to 10 nights. |
| Two or three places | $179 | Two or three bases, or one base for longer than 10 nights. |
| Four or more, or a cruise | $299 | A route, a road trip or a cruise. Any length. |
- Anything that does not fit one of those three shapes is quoted separately rather than bought through the buttons on this site.
- If your questionnaire turns out to describe a bigger trip than the tier you paid for, we will tell you before we start and give you the choice: pay the difference, or narrow the trip to the tier you bought. We will not begin and then send you a bill you did not agree to.
- If you pay for a bigger tier than your trip needs, we refund the difference without waiting for you to ask.
- The prices on this site are the current ones. Changing them does not change what you already paid.
6. Payment
- Payment is taken by Stripe. Your card details go to Stripe and never reach us. Stripe's own terms cover that part of the transaction.
- Prices are shown in US dollars and are the total payable. Any tax we are required to charge is included in the price shown, and nothing is added at checkout.
- Payment is in full and up front. There is nothing recurring, so there is no renewal and nothing to cancel later.
- Your receipt comes from Stripe and carries our support address, which is the same address as the one at the bottom of this page.
7. Your right to withdraw, if you are a consumer
- Consumers normally have 14 days to withdraw from a distance contract without giving a reason (Article 6:230o CC).
- That right does not survive here, for two reasons that the law provides for. A guide is made to your specification and to nobody else's (Article 6:230p sub f CC), and by sending us your questionnaire you are asking us to start work straight away and accepting that the right ends once we have (Article 6:230p sub d CC).
- We do not rely on that, and we do not claim the refund policy is longer than the statutory window, because it is not. What it covers is the part the statutory right never reaches: the statutory right dies the moment we start work at your request, and ours carries on for seven days after the work is finished and the guide is in your hands.
- Products that are not personalised, such as an off-the-shelf destination kit, carry the full statutory 14 day right and the refund policy says so.
- Nothing in this section takes away any right that mandatory Dutch or EU consumer law gives you.
8. Refunds and cancellation
- The refund policy forms part of these terms and sets out every case in full.
- The short version: a full refund at any time before your guide is delivered, and a full refund within seven days of delivery, no explanation needed. A refunded guide stays online for 14 days from the day we confirm the refund and is then deleted.
- We may cancel an order and refund you in full if we cannot do the work properly, if your trip is too close for us to research it, or if the request is unlawful or abusive.
- Refunds go back to the card that paid, through Stripe.
9. Delivery
- Your preview page goes live within minutes of your questionnaire reaching us.
- Your full guide follows 3 to 5 days after that, on one date we confirm by email, not a range. The clock starts when your questionnaire lands, not when you pay, because you control when you send it.
- We need at least ten days before you fly. The research has to happen and the refresh runs three days before you go. If you are flying sooner, write to us first and we will tell you honestly whether we can make it.
- If we are going to miss the date we gave you, we will tell you before it passes rather than after, and you can take a full refund instead.
10. Your guide: access, hosting and the pre-trip refresh
- Your guide lives at a private web address, protected by a passphrase, not linked from anywhere and not offered to search engines.
- It installs to your home screen and works with no signal. Once it is loaded on a device it keeps working there whatever happens to our hosting.
- We host it for 12 months from delivery, then delete it. Ask us to take it down sooner and we will. A guide refunded under section 3 of the refund policy stays online for 14 days from the day we confirm the refund instead.
- Hosting ending is not the guide ending for you. Open it once on a device before the 12 months are up and it keeps working there offline, with no connection to us. If you want a copy to keep, ask before the 12 months are out and we will send you one.
- If we ever have to stop hosting earlier than that, we will give you at least 30 days' notice and a copy you can keep.
- Three days before you travel we re-check the time-sensitive places and update the guide where it is on the same page. That refresh also picks up a change of dates to the same destination at no charge. A different destination is a new guide, and we credit what you already paid toward it.
- The link and the passphrase are yours to share with your own family and friends. Publishing them, or the guide's contents, anywhere public is covered by section 13.
11. Research, verification and accuracy
- We check four things about every place that reaches your guide: whether it is any good judged against the place it is in, whether it is open on your exact dates including seasonal closures in the local language, how long it really takes to get there routed from where you are staying, and whether it works at the hour you would actually go with your children's ages and the weather that day.
- Every place carries the source it was checked against, so you can confirm the one thing that matters on the morning it matters.
- We use modern research tools, including AI, to search wide. Nothing reaches your guide until it has been verified against a live source and a person has reviewed the shortlist.
- Places close, prices change and opening hours move, and we cannot promise otherwise. What we promise is that the checks above were done, that the sources are named, and that the time-sensitive ones are checked again three days before you travel. We do not warrant that any place will be open, available or as described on the day you arrive.
- Nothing in a guide is a booking or a reservation. We do not book, buy, hold, reserve or contact anywhere on your behalf, and nothing in your guide is there because somebody paid to put it there.
The places in your guide are independent businesses
- Every restaurant, museum, beach, tour, park, shop and transport operator named in a guide is an independent third party. We have no relationship with them, no arrangement of any kind, and we take no commission from anyone. We are not their agent, reseller or representative, and we are not your agent in any dealing with them.
- Any contract for entry, food, drink, tickets, tours, transport, hire or accommodation is between you and that business. We are not a party to it and have no control over how they run it.
- We are therefore not liable for anything a place does or fails to do. That includes, and is not limited to: being closed, on a public holiday, for seasonal closure, for maintenance or for any other reason; being full, sold out or fully booked; changing or ending its opening hours, prices, menu, rules, minimum ages or accessibility arrangements; refusing you entry or service, before or after you have paid; cancelling, curtailing or rescheduling anything; charging more than a guide indicated; being under construction, closed off or inaccessible; or being different in any way from how a guide describes it.
- Where you pay a business directly and do not get what you paid for, that is a matter between you and them. We will help you work out who to contact if you ask, but the money is not ours to return and we have no claim on your behalf.
Allergies, health, accessibility and safety
- Nothing in a guide is medical, dietary, legal, financial or safety advice, and nothing in it should be treated as one.
- Allergy and intolerance answers shape which places reach your shortlist. They do nothing more than that. We do not verify that any place, any kitchen or any dish is safe for a particular person, and we are not qualified to. Ingredients, suppliers, preparation, cross-contamination and staff change constantly and without notice, and only the venue knows what is true on the day.
- You must check directly with the venue, every time, before anyone eats. A place appearing in your guide is not a statement that it can cater for an allergy, an intolerance or any other dietary or medical need.
- The same applies to accessibility. Answers about wheelchairs, walking, strollers, carriers or anyone who tires quickly shape which places reach the shortlist and how far apart they sit in a day. They are not a warranty that a place, a route, a surface, a lift, a toilet or a path is suitable for a particular person, and you should confirm anything that matters with the venue.
- We are not liable for illness, an allergic or anaphylactic reaction, food poisoning, injury, accident, or any other harm arising at, on the way to, or in connection with any place, activity or route mentioned in a guide, or arising from anything you ate, did or travelled on there.
- You remain responsible for the safety and supervision of everyone in your party, including children, and for deciding whether any place or activity is appropriate for them.
- Nothing in this section limits our liability for intent (opzet), gross negligence (grove schuld), or death or personal injury caused by our own act or omission, and nothing in it takes away a right that mandatory Dutch or EU consumer law gives you.
12. What we ask of you
You agree not to:
- use the service unlawfully;
- resell, sublicense or republish a guide, or any substantial part of one, without our written permission;
- publish the private link or the passphrase anywhere public;
- scrape or systematically copy a guide by automated means;
- give us answers you have no right to give us, including personal details of people who have not agreed to be included;
- interfere with the security or operation of the site or the hosting; or
- use the service in a way that exposes us to legal liability.
We may suspend access to a guide that breaches this section, and we may take it further if the breach is serious.
13. Intellectual property, and what you may do with your guide
- The engine, the design, the software, the research method and everything we have built to make guides remain ours.
- Your answers stay yours. You give us permission to use them to research, build, host and refresh your guide, and for nothing else.
- Your guide is licensed to you personally, for your own trip and your own family and friends. That includes handing it to the people travelling with you, and to grandparents at home. It does not include publishing it, selling it or using it commercially.
- We may reuse the underlying research about places, and describe our work in general terms, but only with everything about your family stripped out. We will not use your family name, your itinerary or your questionnaire in anything public without asking you first.
- Nothing in a guide may have our credit line removed from it.
14. Privacy
- We handle personal data under the GDPR and Dutch law, as set out in the privacy policy, which forms part of these terms.
- The allergy and accessibility answers are special category data and are processed on your explicit consent. You can withdraw that consent at any time.
- Nothing about your family is published in your guide. That is enforced by the software that builds it.
- Ask us to delete your data and we delete it, apart from the payment records Dutch tax law requires us to keep.
15. Confidentiality
- Your questionnaire, your itinerary and everything you tell us about your family are confidential and stay between us.
- We will not name you as a customer, quote you or show your guide to anyone without asking you first.
- This does not cover information that is already public, that we already had, or that we work out independently.
16. Availability and changes
- We aim to keep guides available at all times and cannot guarantee it. Planned work is announced in advance where that is practical.
- We are not liable for an outage caused by your device, your connection, or a failure at one of the providers listed in the privacy policy, where we chose them with reasonable care.
- If we stop offering the service altogether, guides already delivered stay online for at least 30 days and we send you a copy you can keep.
17. Limitation of liability
- Our total liability for any claim is capped at the amount you paid for the guide the claim relates to.
- We are not liable for indirect or consequential loss. That includes a missed booking, a closed or full venue, refused entry, money paid to a third party, a wasted day, travel, parking, fuel or accommodation costs, a cancelled or shortened trip, a missed flight or sailing, lost enjoyment, lost time and distress, however the claim is framed and even if we were told it could happen.
- We are not liable for anything covered by section 11, which sets out that the places in a guide are independent businesses whose acts and omissions are not ours, and that allergy, dietary, accessibility and safety information must be confirmed with the venue itself.
- We are not liable for loss that follows from acting on your guide without checking the source we listed beside the place, or from information you gave us that was wrong or incomplete.
- We are not liable for the acts of the providers listed in the privacy policy, where we chose them with reasonable care.
- None of the above limits our liability for intent (opzet), gross negligence (grove schuld), death or personal injury, or anything else that mandatory Dutch or EU law does not allow us to exclude. If you are a consumer, your statutory rights are untouched by this section.
- These limits apply equally to anyone working for us or with us on your guide.
18. Indemnification
- If a claim is brought against us because you broke these terms, published a guide you were not entitled to publish, or gave us someone else's personal details without the right to, you will cover the cost of dealing with it.
- We will tell you about any such claim promptly and work with you on it.
- You may not settle a claim in a way that binds us or admits fault on our behalf without our written agreement.
19. Force majeure
- Neither of us is liable for a delay or failure caused by something outside our reasonable control: strikes, government action, war or terrorism, natural disaster, fire, epidemic, internet or infrastructure failure, a cyberattack, or an outage at one of the providers we depend on.
- If that stops us delivering for more than 30 days in a row, either of us can end the agreement, and we refund anything you have paid for work not delivered.
20. Changes to these terms
- We may update these terms. Changes that matter are notified by email at least 30 days before they take effect to anyone whose guide we are building or have built.
- Corrections and clarifications go up without notice.
- The terms that apply to your order are the ones in force on the day you paid. A later change does not reach backwards into a guide already bought.
21. Assignment
- You may not transfer your rights under this agreement to anyone else without our written consent.
- We may transfer ours to a successor or a buyer of the business, provided they take on every obligation we owe you.
22. Miscellaneous
- Any change to these terms is only valid in writing, and agreeing to one does not create a rule for the next order.
- Our records of your order and your questionnaire are valid evidence of what was agreed, unless you can show otherwise.
- If any part of these terms turns out to be unenforceable, the rest still stands and the unenforceable part is replaced by the closest valid version of it.
- Not enforcing something once does not mean we have given up the right to enforce it later.
- The place of performance is Amsterdam, the Netherlands.
- These terms, the privacy policy and the refund policy are the whole agreement between us, and replace anything said before.
23. Governing law and jurisdiction
- Dutch law governs these terms and the agreement, including any non-contractual claim arising from them.
- Disputes with business customers go to the competent court of Noord-Holland, the Netherlands.
- If you are a consumer living elsewhere in the EU, you keep the protections of your own country's law and can bring a dispute before a court there.
- Both of us agree to spend at least 30 days trying to sort a dispute out directly before starting formal proceedings.
- EU consumers can also use the European online dispute resolution platform at ec.europa.eu/odr. Our contact address for that is hello@northcliffjourneys.com.
24. Expiration of claims
Any claim you have against us expires one year after the event that caused it, in place of the statutory limitation period (verjaringstermijn), unless mandatory law says otherwise. If you are a consumer and mandatory law gives you longer, you get longer.
